If the UCA came into force in !977 and I bought the boat / had the survey Post !977 then the UCA was in force. It was probably around 1980-82 and was our first 'big' Sea-Boat. I have no idea if the UCA was taken into account by the Solicitor, if I pay someone to do something that I have little or no knowledge about then I would not question him. He was the 2nd Solicitor I spoke with - the first said you need a marine/maritme specialist for anything to do with boating contracts (apparently they are a law unto themselves) so they referred me. Having read the survey he wrote some letters to the surveyor, which were not answered, and after a few weeks I asked about going to court, that was when he said I had no case, the contract states (basically) that nothing he has either 'said, or not said' can be used against him. He was prepared to go to court but said I would lose and end up paying not only his costs but all the surveyors costs as well. Then you go on about how much a boat cost you because the surveyor was wrong. You seem to have a very selective memory and easily get confused - I wonder why ? The boat I had a survey on which resulted in me trying to take the surveyor to court was purchased in about 1980 and was in Wales. The boat which did not have the relevant paperwork to allow it to be legally sold in the EU was the one where I offered £80,000 below the purchase price which was accepted. It was in Croatia and this was in November 2015. I told the broker I did not want a survey, he refused to sell it without a survey, I refused to have a survey. In the end the broker paid for the surveyor and because the boat was too big to be lifted out anywhere in Croatia the broker had to take it to Italy to a yard that could lift 23 foot beam boats. Even then it was 'tight' and fenders had to be lifted. We brought her 'home' starting end of April 2016 as the insurance would not provide cover for a boat to transit the Bayof Biscay before May 1st. It took us 28 days (including 2 days R&R) to do the 3050 miles. Rijeka to Hull. We have now had to take her down to Plymouth because nowhere on the east coast could lift her - even the yards that handle the wind-farm service catarmarans cannot lift her (they are only 19 foot beam) Is that now clear ? Yes we hired a Yachtmaster instructor with 'millions of miles' of deliveries on his log book. It was 24/7 so it was a watch system and we did not have enough experience for such a voyage - he certainly took us thru worse weather than I'd have ever gone out in - there was a force 8 straight on the bow one day after leaving the toe of Italy and we had to turn back and run for shelter.
