hi folks

copied Item in todays TIMES newspaper

Canal boats are free to moor along waterways without planning permission, a planning inspector found in a crucial ruling .

The decision was a blow to Kennet District Council , which served an enforcement notice on 17 boats and narrow boats moored at ladies bridge on the Kennet and Avon canal...end quote

anybody got any history on this one ?

Hi BB,

The local landowner at Ladies Bridge, was planning to build a property near the canal bridge and wanted to close the nearby moorings. The bridge had been built by the K & A builders to help the original owner accept the canal, the bridge being named after his wife. Now their descendant's don't want boats next to their new property and using their influence, got the local council to agree and serve an enforcement order.

Now BW did not want this to set a precedence, with all new developments closing moorings, so they went to court and thankfully, won.

M&P.

I mentioned this in another thread but was not sure if it was the same one I had heard of, you have now confirmed my thoughts.

I went to the Appeal Hearing, which the above refers to.

Kennet DC could have appealed against the decision that the Planning Inspector made, and thus the actual "Winning" part didn't happen until 4 weeks later.

Yes It's now all done and dusted. See the BWW write up in "Bankside Moorings Safe ...for now" in Waterways news
