My previous reply is in error on a small point,

 

I have just re-read a section of Halsbury’s Laws of England that I had attached to an email of years back [looking for something entirely unrelated to waterways &/or law], and noticed that I have forgotten/never noticed an obscure provision from the British Transport Commission Act 1954 s.16(4) as amended by the Decimal Currency Act 1969 s.10(1).

 

I was wrong – there IS a provision for a further daily penalty in the case of continuing offences under the byelaws:

 

in the case of a continuing offence, a further penalty not exceeding £2 for each day on which the offence is continued after conviction.”

 

Still considerably less than the 1971 provisions of course, and applies only post conviction of the offence, but still - an extra £60/month approximately, until remedied. As much again, pro rata, as most annual licences.
