I would have thought if the doctored survey was used by the vendor as an inducement to buy, that would be considered fraud.

 

Indeed, morally it is fraud, but establishing that legally is an entirely different matter. In the event of legal action the vendor might claim that the document was not doctored when shown to buyer and must have been changed since - by the new owner in order to induce a subsequent purchaser for example. So fraud could be very difficult to prove.

 

All I'm saying is by all means use an old survey as a basis for commissioning a new survey, but don't use it as the basis for buying a boat.
