  10. What do the experts here think the average engine hours for say a year, for a live aboard should be about?
  11. Where have you been, on another planet? Nothings safe anywhere anymore, no matter how much its worth. I cant believe you left it out unattended for a couple of days, darn bad news though, I`d be livid, probably more at myself for leaving it out. I Hope you dont leave your new one out.
  12. Thanks for that Phill. So the boat is for sale, But, there may be a hundred and one reasons why though, maybe it`s actually been fixed elsewhere? You mentioned another builder, maybe it has been refitted by these? Red herring? Maybe its simply that the original builder applied for info and got a load of B--ll S--t as the owner knew it was him? Maybe as I said before, it could all part of the claim against the builder to help them get a better deal off a judge? If they can prove they have bent over backwards to settle it fairly, it would certainly go in their favour, and they could be awarded even more costs. (Do a google) Maybe they came to an amicable agreement in their dispute and its all sorted, if they didn`t, after all this time, what does this tell you about it`s original builder though? Your right theres always two sides to every story, but I think dealing with cases like this people use professionals and they will not make up stories, or at least I wouldnt think they would, so there must be more to this than your friendly boatbuilder is telling you, friendly and nice doesnt make them honest, I doubt he would say yes I did it bad if he had. I just think he should have made his customer happy at the end of the day if the customer doesnt go away happy, he`s not going to be recomended and it`s only the builder that will suffer, and in my opinion so he should. I think any tradesman in this posistion is a fool to let the customer slip out of his reach and its their own stupid fault. I definately think we should stop all this speculation (and thats all it is) as it is doing no one anygood, it`s keeping it in the fore front of everyones minds, the builder wont sell boats and the poor chap whos trying to sell it for whatever reason will never sell it. I do know the owner of the boat is on this forum and I havent seen him around for some time, There may be a reason? I`m sure we will all be informed how things have progressed in the future unless he has just had enough of us all sticking our noses into his business, as I remember it was not he who bought it to our attention in the first place. Just to bring it back on topic did they have this contract I wonder?
  13. Hi Phil I`m sure your refering to my reply? My sincere appologies to Charles, it certainly wasn`t meant to be like that, its just type, Sorry, I just feel for these people that have lost money. Re` the Westwood saga, can you please tell us the other side of the story, and why they were so wrong to complain? and re` it being for sale, Maybe it`s been in for repair? Or it may be something to do with their court case if there is going to be a court case, You probably know more than any of us on that score. After all it`s been a while now. Have you ever heard of your "obligation to mitigate your Loss"? This would be helpful to the defendant in any litigation case, as it could save them money, so it shouldnt be seen as anything malicious if the boat is for sale without being repaired anyway, and the higher the price obtained the less the defendant will have to pay. If this is the case and WE DO NOT KNOW, Do you? Anyway please forgive me if this comes across yet again as combative it`s just an oppinion and not meant to be

  15. Agreed and that is why Pav should have the guts to get out now rather than later, should he have serious doubts. £2000 is a lot to lose, but its better than £60 000 or whatever.

Pav, I dont know what you paid in Deposit but if you are going to pull out think seriously like this....... better to go to court now if he fails to pay you, Possibly in small claims court, for a small amount (about £80 for court), than later on with a larger amount that will take many months and cost lots more to recover. I have a friend who had doubts with his builder but carried on, and all his doubts came to fruition, (I hope thats the word) and now he is over £6000 in with lawyers and surveyors, and his proceedings were only started THIS week, (£700 for court alone). It will cost in the region of £12000 to £15000 in all to get to court, he tells me with baristers and the rest of it, but he is insistent theres nothing else he can do, other than let them get away with it, so you will have to spend more to get your money back, better you sort it now than later on or you will find you will have to have deep pockets and a very strong will. The legal system is slow and expensive in this country and many crooks know you are very unlikely to take action because of this and think they can get away with it. Other builders and suppliers who may have sympathy with your builder or other builders that are coming under similar scrutiny should be worrying, rather than defending them, because their bad behaviour could affect them too, in that no one buys new.
  17. Great news, I`ll keep my fingers crossed for you. It`s all very well for the likes of Charles (or others for that matter) to say it may be a one sided story or some kind of Saga, you usually find Its people like him/them that will shout the loudest when theres something wrong with the toothpaste they purchased for 50p let alone the ammount you could lose on a boat, I cant imagine the worry you must have. Lets just hope your builder means what he says and it wasn`t just a fob off to shut you up, and that his word is good and you get sorted.
  18. Well lets hope Dave Shrop gets it sorted ASAP it cant be very nice being in disbute. I just cant believe how many owners that I`ve met on the cut with problems with their builders, and I can see the difference to others where the builder has come out travelling miles to sort out what I thought were trivial jobs. I dont think all these owners are making up their stories. Or perhaps we should not believe the ones with positive comments?
  19. I dont know why you call this or the Westwood story a one sided story or a saga, have you met them or seen the boat for your self? Can you explain please why you think they would make up such a story? I would have thought they will have survey reports and estimates supporting their claims? Do you not think they had legal advice? What do you know that we dont? If you have heard the other side of the story have you seen it backed by any evidence? or was it just a one sided story that you believed? I think Timleech talks about somebody (in another thread) that I met quite by chance, I may be wrong but the stories are incredibly similar, and if they are who I think they are, I wonder what these people would say about your remarks? I was told these people bounced a cheque for £20 000, what utter nonsence, that was just a lie put about by the person they complained about. Tradesmen dont want to spend money, it`s as simple as that, There are good and bad in all trades, and just because a guy is a nice guy or a good liar, or you know him, doesnt make him good at his job, good after sales service can cost money, and some tradesmen just aren`t bothered once they`ve had your hard earned cash, thats the difference between good Tradesmen and bad I suppose? A good reputation takes years to earn but a bad one can be had quite quickly. Do you ever watch "House of Horrors"?, I dont think these tradesmen think like you or I I`ve seen your boat by the way Charles and it is really lovely, Gorgous infact. I wonder what you spent on that and how you would feel if you had a problem with it such as Westwood has? edited to add that I am not related to the case, other than in interest, the same as every body else on here.

I was wondering the same. if it does begin with M, I think he will be out of business very soon as I have seen some really big money and I mean BIG money being spent to sort him out by another forum member who is not short of a bob or two, who was let down big time. Sorry I cant say any more so Dont ask. Why cant they settle disputes amicably? It saves so much money and bitterness I thought I`d better add we may be talking about totally different people here, it just sounds so similar to me???

  23. He probably got or will get a slap on the wrist, and theres loads on here will say thats the best way to deal with him. Yesterday I heard some woman screwed us out of £10,000 in benefits she had 4 jobs and a husband, she got 80 hours community service and had to pay £75 towards the costs, what were they thinking about in court, how the hell can they be so cruel with her?
