  3. Well my licence restricted to six months ( because I my overstays were unauthorised ) has just been paid at the full six month licence rate 60 ft - £961.13 ÷ 2 = £480.56 My six month invoice just paid £580.27 Difference £199.41
  4. Defending themselves in court is going to be their sole purpose if they keep on ignoring the law. Shoosmiths must think all their Christmases have come at once by securing such a rich and stupid client, how long before it tops half a million a year legal expenses ? They are going to crash and burn again unless they stop trying to promote the terms and conditions as " the law", at some point they will have to admit no one has to agree to it, or else they will have to refuse to issue a licence to anyone who declines to agree to it, they will then have broken the law, and will need rescuing from that hole as well.
  5. Am I right or wrong in that CRT once said that if they only offer you a six month restricted licence it would be exactly half the cost of a 12 month licence and not the six month fee which is about £200 more expensive ?

I paid the licence renewal on another boat I own ( not Tadworth) today, the customer services person asked me if I agreed to the terms and conditions, I said no, he said I have to because they are "the law" and the licences are issued under " section 43 of the 1962 transport act" !! I said I just wanted my statutory licence please, we came to some kind of agreement, where neither of us gave way but it went through, he probably just ticked the box anyway. Obviously I don't expect a customer services operator to get involved in the legal points, but he was reading what he had been told to read off his screen. Note that they tried to put a late payment charge on, but they had put a block on my account from before it expired on the 30 th April to 2nd of June, when I challenged it, they claimed they had took it off as a "goodwill gesture" ! I feel honoured not to be defrauded, cheers CRT.
  9. The tidal moorings at Strand on the green, and Isleworth where I have done many a boat blacking are now £15 a day, sadly no one is prepared to offer anything for free out of goodwill anymore in this country.
  10. Truth does not figure anywhere in the canal and river trust. I don't know what the answer is, if they can invent the rules as they go without any consequences you cannot have any kind of reasonable dialogue with them.

How about a motor and butty fixed together breasted up, let's say for instance by welded closed chains bow and stern, putting aside any practicle issues, there is nothing in law i know of saying this is not one craft for licencing purposes, would CRT have to accept it under the " what is not expressly prohibited is allowed" rule ? ( I know for a fact they won't. )

CRT have agreed to re issue the licence for Tadworth starting from the 1st of July, using the EXACT SAME details I submitted in my original application in Febuary i.e admitting there was nothing wrong with my original application. I may have broken the record for a licence application at 126 days ?
  15. Brown water coming from the tap is what happens when old pipes are disturbed somewhere along the line, it happened in the marina I was in, the water company just told us to run it off. It was gone in an hour.
  16. I've posted the question before of why are CRT using the section 8 process against non licence payers, instead of other easier and cheaper remedys available to them. I can only guess the answer is malicious.

  18. It says "travelling separately " not " mooring separatly" hence the motor can travel or be moored anywhere else during the butty's 14 days in one place, then return to collect it. I still don't see the problem.
  19. Another issue has come up for Tadworth, the licence will only be granted with the mooring I have, because I didn't move TW enough in 2013* to comply with CC guidelines. I have another unpowered boat I want to licence as its butty, however CRT say that the butty must have a mooring as well. I don't intend to be on my mooring, and will be CC'ing both boats together. *note that Tadworth has been off CRT waters since then. Is the record of cruising 2 & 1/2 years ago still relevant ? The conditions for a butty licence are this... "50% discount for a butty boat more than 50ft long that never travels separately from its motor boat. The motor boat must be licensed and licences for motor and butty must be concurrent with the same start and end date. " I don't see that I need a mooring for the butty, unless I intend to keep my motor on a mooring long term, even then I could in theory move the butty every 14 days with the motor, then return to my mooring. ???

  21. Tony is correct, the golden rule of trading on the canals is never, ever tell CRT what you are doing. I learnt that a long time ago from BW. They wont wish you luck, try to help you, and honour the business licence they sold you, from the moment you get it they will actively work to try and interfere and ruin what your doing. If the OP now wants a standard licence, they cannot refuse that because they "think" he might use it as a business, but they will obviously check and find him out if he does, the local EO will be all over him like a rash, I wouldn't bother with the idea now, just consider the golden rule in future.

Its interesting to note that in my case CRT never once in 2 1/2 years asked me to pay my licence fee debt for 2013, but instead started digging a huge hole of lies, and unlawful shannanigins of which they now have humiliatingly lost on every single issue, and publically made themselves look like idiots. A £65 small claims court action would have made me pay up, and all of this could have been avoided. Why are CRT insisting on using the section 8 process, even though its loosing them money, and not achieving the aim of retreiving lost licence fees ? I know it wasn't news to some, but the Tadworth case has forced then to admit again that the court order does not stop a new licence application, I hope it will be impossible for CRT to lie about that in future. The section 8 process looks even more stupid now. I'm wondering if there is a requirement in law for the claimant to use the most appropriate method of obtaining the outcome they want, can the defendant argue that the section 8 is not appropriate for debt recovery ?
  23. A bnb is a business, on land there are laws to comply with regards safety, hygiene, and tax ect, you can't just put a sign in your window and crack on. Why CRT would want to stop this on boats is a mystery, I thought they wanted more visitors ?
  24. Wasn't it mentioned on here that NABO had issued a guide to not agreeing to the T & C's ? Has anyone got a copy of that ?
