My boat is currently moored on an end of field mooring. I pay CaRT for the mooring at 50% (£675 pa)of nearest official mooring rate and have been paying the landowner monthly (£110) for access and water. Total cost has been £1995 pa
I have advised the landowner that I will not be requiring access for 12 months due to a change in circumstances and it has been my intention to leave the boat where it is with a view to picking up the access charges again when required. The landowner is, understandably, miffed. There has been mutterings about removing my boat and letting the mooring to somebody else.
The mooring itself is on decking that overhangs the canal rather than actually on the farmer's land. I actually own the decking etc. My argument with the landowner has been that I own the decking and pay CaRT for my boat occupying the water space and, in my opinion, the landowner can not remove my boat and occupy my property without my expressed permission.
My additional understanding is that the landowner has responsibility up to the fence line above the mooring. The landowner has previously advised that they are not responsible for any work below the fence line. Previously they had declined to sort out trees below the fence line stating that it was not their responsibility.
I would prefer to leave the boat in situ whilst continuing to pay CaRT.

ps the landowner is not troublesome and this is a new situation for both of us. If all else fails I am aware that I could just sell on my decking and at a similar (£2k pa) price park my boat up in a marina. This is real consideration as my liveaboard neighbours are a tad concerned about my situation and how it may effect them.
