    I cant believe you left it out unattended for a couple of days, darn bad news though, I`d be livid, probably more at myself for leaving it out. I Hope you dont leave your new one out.

    So the boat is for sale, But, there may be a hundred and one reasons why though, maybe it`s actually been fixed elsewhere?

    You mentioned another builder, maybe it has been refitted by these?

    Red herring? Maybe its simply that the original builder applied for info and got a load of B--ll S--t as the owner knew it was him?

    Maybe as I said before, it could all part of the claim against the builder to help them get a better deal off a judge? If they can prove they have bent over backwards to settle it fairly, it would certainly go in their favour, and they could be awarded even more costs. (Do a google)

    Maybe they came to an amicable agreement in their dispute and its all sorted, if they didn`t, after all this time, what does this tell you about it`s original builder though?

     

    Your right theres always two sides to every story, but I think dealing with cases like this people use professionals and they will not make up stories, or at least I wouldnt think they would, so there must be more to this than your friendly boatbuilder is telling you, friendly and nice doesnt make them honest, I doubt he would say yes I did it bad if he had. I just think he should have made his customer happy at the end of the day if the customer doesnt go away happy, he`s not going to be recomended and it`s only the builder that will suffer, and in my opinion so he should.

    I think any tradesman in this posistion is a fool to let the customer slip out of his reach and its their own stupid fault.

     

    I definately think we should stop all this speculation (and thats all it is) as it is doing no one anygood, it`s keeping it in the fore front of everyones minds, the builder wont sell boats and the poor chap whos trying to sell it for whatever reason will never sell it.

     

    I do know the owner of the boat is on this forum and I havent seen him around for some time, There may be a reason?

    I`m sure we will all be informed how things have progressed in the future unless he has just had enough of us all sticking our noses into his business, as I remember it was not he who bought it to our attention in the first place.

     

    Just to bring it back on topic did they have this contract I wonder?

  3. I ain`t going to get involved here other than to say that these problems do seem to keep cropping up and that the Westwood saga was to my certain knowledge , SOMEWHAT one-sided. Just believe me - I have no axe to grind on that particular issue and it`s best forgotten now.

    ( I`m told incidentally that Westwood is now for sale described in the most glowing terms and attributed to another builder- but I haven`t tried to find out wether or not this is actually the case and it could be a red-herring.)

    In order that I`m not told off for saying something that makes no contribution to the debate " Put up or shut up" or whatever I suggest that Dave keeps the group informed of progress. This in itself will ,I`m fairly sure, keep the work rolling . I know a builder beginning with "M" who certainly knows how damaging bad publicity on line can be , guilty or not.

    I must say that the response to Charles perfectly legitimate opinion seems a bit over combative. We can agree to differ can`t we?Oh, and yes - it is great news. I hope it comes right in the end.

    Hi Phil I`m sure your refering to my reply? My sincere appologies to Charles, it certainly wasn`t meant to be like that, its just type, Sorry, I just feel for these people that have lost money.

     

    Re` the Westwood saga, can you please tell us the other side of the story, and why they were so wrong to complain? and re` it being for sale, Maybe it`s been in for repair? Or it may be something to do with their court case if there is going to be a court case, You probably know more than any of us on that score. After all it`s been a while now.

    Have you ever heard of your "obligation to mitigate your Loss"? This would be helpful to the defendant in any litigation case, as it could save them money, so it shouldnt be seen as anything malicious if the boat is for sale without being repaired anyway, and the higher the price obtained the less the defendant will have to pay. If this is the case and WE DO NOT KNOW, Do you?

     

    Anyway please forgive me if this comes across yet again as combative it`s just an oppinion and not meant to be :)

  4. The problem with taking a boat builder to court is it's hard to win any reward in the sense of money even if you win.

     

    Most boat builders aren't worth much, the working capital to complete the boat comes from the customer. Most lease the property and equipment used to go about the business so in asset terms are worth next to nothing. A lot of companies at the moment both small and mid are operating on providing a wage rather than profit basis. (No money in the bank!)

     

    If you get one of these companies backed into a corner in court it is easier for them to just go home and start looking for a new job.

     

    Your award from the court is worth xxx amount of pounds of nothing and nothing is exactly what you end up getting.

     

    Agreed and that is why Pav should have the guts to get out now rather than later, should he have serious doubts. £2000 is a lot to lose, but its better than £60 000 or whatever.

Pav, I dont know what you paid in Deposit but if you are going to pull out think seriously like this....... better to go to court now if he fails to pay you, Possibly in small claims court, for a small amount (about £80 for court), than later on with a larger amount that will take many months and cost lots more to recover.

     

    I have a friend who had doubts with his builder but carried on, and all his doubts came to fruition, (I hope thats the word) and now he is over £6000 in with lawyers and surveyors, and his proceedings were only started THIS week, (£700 for court alone). It will cost in the region of £12000 to £15000 in all to get to court, he tells me with baristers and the rest of it, but he is insistent theres nothing else he can do, other than let them get away with it, so you will have to spend more to get your money back, better you sort it now than later on or you will find you will have to have deep pockets and a very strong will. The legal system is slow and expensive in this country and many crooks know you are very unlikely to take action because of this and think they can get away with it.

     

    Other builders and suppliers who may have sympathy with your builder or other builders that are coming under similar scrutiny should be worrying, rather than defending them, because their bad behaviour could affect them too, in that no one buys new.

  6. Been to crick

    Well that seems to have sorted it - very apologetic, stated it was all a misunderstanding and that the fitters will start work on our boat again on Wednesday and that it will be completed in 14 days. That no money is required until completed. We will wait and see, I think it will be nearer 4 weeks with the amount of work required. Phew!

    Still long traffic queues from A5 - M1 to Crick show. Needs entrance problem and parking sorted. Only a single width opening so only one car in or out and only one from one direction at a time. Needs two double entrances. Once in all cars are directed to same area to park and each car has to wait for the one in front to park. They should split the cars coming in so as to keep the traffic moving.

    Great news, I`ll keep my fingers crossed for you.

     

    It`s all very well for the likes of Charles (or others for that matter) to say it may be a one sided story or some kind of Saga, you usually find Its people like him/them that will shout the loudest when theres something wrong with the toothpaste they purchased for 50p let alone the ammount you could lose on a boat, I cant imagine the worry you must have.

     

    Lets just hope your builder means what he says and it wasn`t just a fob off to shut you up, and that his word is good and you get sorted.

  7. Well lets hope Dave Shrop gets it sorted ASAP it cant be very nice being in disbute.

     

    I just cant believe how many owners that I`ve met on the cut with problems with their builders, and I can see the difference to others where the builder has come out travelling miles to sort out what I thought were trivial jobs. I dont think all these owners are making up their stories. Or perhaps we should not believe the ones with positive comments?

  8. I hope this is not one of those one sided stories like we had with the nb westwood saga. Does not ring true somehow and I cant see why the builder would mess you around for no aparent reason, he is business to build boats, provide good service, build a good name for himself and make a living. Giving you the benefit of the doubt I would seek legal advice and deal with it that way

    I dont know why you call this or the Westwood story a one sided story or a saga, have you met them or seen the boat for your self? Can you explain please why you think they would make up such a story? I would have thought they will have survey reports and estimates supporting their claims? Do you not think they had legal advice?

     

    What do you know that we dont? If you have heard the other side of the story have you seen it backed by any evidence? or was it just a one sided story that you believed?

     

    I think Timleech talks about somebody (in another thread) that I met quite by chance, I may be wrong but the stories are incredibly similar, and if they are who I think they are, I wonder what these people would say about your remarks? I was told these people bounced a cheque for £20 000, what utter nonsence, that was just a lie put about by the person they complained about.

     

    Tradesmen dont want to spend money, it`s as simple as that, There are good and bad in all trades, and just because a guy is a nice guy or a good liar, or you know him, doesnt make him good at his job, good after sales service can cost money, and some tradesmen just aren`t bothered once they`ve had your hard earned cash, thats the difference between good Tradesmen and bad I suppose? A good reputation takes years to earn but a bad one can be had quite quickly.

     

    Do you ever watch "House of Horrors"?, I dont think these tradesmen think like you or I

     

    I`ve seen your boat by the way Charles and it is really lovely, Gorgous infact.

     

    I wonder what you spent on that and how you would feel if you had a problem with it such as Westwood has?

    I was wondering the same. if it does begin with M, I think he will be out of business very soon as I have seen some really big money and I mean BIG money being spent to sort him out by another forum member who is not short of a bob or two, who was let down big time. Sorry I cant say any more so Dont ask.

     

    Why cant they settle disputes amicably? It saves so much money and bitterness

  10. He probably got or will get a slap on the wrist, and theres loads on here will say thats the best way to deal with him.

     

    Yesterday I heard some woman screwed us out of £10,000 in benefits she had 4 jobs and a husband, she got 80 hours community service and had to pay £75 towards the costs, what were they thinking about in court, how the hell can they be so cruel with her? :captain:;):cheers:

    Everyone suddenly seems determined to try and make everyone else pay as much as they possibly can... Is this some kind of competition?

    BW licence (and private marina fees)

     

    Now am I missing something? Would someone like to point out a tax I'm not paying, and get all het up about it? I'm only 34 can i get away without paying death duty for just a few more years please?

     

    Well you may or may not have a TV? but you didn`t mention the TV licence which is basically a tax, difficult to convince them you dont have a TV, :wacko:

  12. Talking about surveys, I know this is a little :captain: sorry but, would you consider a survey to be a legal document? I ask because I saw one on a boat recently and there were one or two things I saw that just were not right, unless they had been changed. It did make me wonder.

  13. I needed to get online in preparation for our ‘Epic Journey’ but didn’t know which was the best way to do it. I know I have left it rather late with only four days before we start, but the time just disappeared so fast.

     

    I tried four providers and all of them were rubbish, all they wanted to do was sell me a phone and said to use that for the internet. I finally went to T-Mobile and what a difference, not only do they actively encourage you to use your laptop while mobile they give you 3 gigs of down/upload capacity!!!!! And for a set price with NO extra costs added on!!

     

    It took about 10 mins to load the software, another couple of mins for the 3G card to load the drivers etc and there I was ….. online!!! Not as fast as broadband but one hell of a lot faster then dialup! I went online to check my emails and it downloaded them straight away, I didn’t need to change any of the settings. Another bonus is that if it cannot connect with 3G it then scans for wi-fi hot spots, wireless lans etc until it can make a connection.

     

    I am really impressed with T-Mobile’s 3G data card, its quick, its simple, its got a humungeous down/upload capacity and for only £29.00 per month with no extra costs !!! I would heartily recommend it to anyone looking to go online while afloat.

     

    Whoops, yes it`s brilliant isn`t it and I get £34`s worth of free phone calls too at £2 less than you pay with same company......sorry :D

  14. Thanks John. Ten years ago, I tried and failed to buy a beautiful dutch barge moored in Bristol - I ended up buying a house instead. Thank goodness I did, or I wouldn't be able to make this move now.

     

    Anyway - I'm trying to keep my feet on the ground and tell myself that it could all fall through ( if my house buyers withdraw their offer), while at the same time telling myself I may need to move in 6 weeks time! Aaaagghhh! :huh:

     

     

    Gosh your nerves will be shot by the end of this period untill completion, I know I`ve been there, in the same boat so to speak

    There's a pipe coming up out of the ground, but no tap on it yet.

     

    There's also a landing stage for passing boats, with another blanked-off pipe, and a brick building with 3 doors, whose purpose is a mystery. BW were intending to fit a DIY pump-out, but the neighbours objected, so I think the plan changed to Elsan point, but when any of this comes to fruition - your guess is as good as mine.

     

    Back on topic though, is it actually possible to filter or treat canal water to such an extent that it could be used for washing (whether yourself or your crocks)?

     

     

    I reckon yes, but at what cost?

     

    In Malta they filter the sea to drink, I wouldnt drink it.

     

    With this idea of Carries she might as well forget the storage and just scoop up the canal water as and when required, dont you think?, and then filter it or whatever it is shes thinking of doing to it, and use it.

     

    I was wondering also, how is this of any purpose, catching rain water??

     

    This has to be one of Carries worste ideas, sorry :P
