  1. hi julian yes and no in my case , at both ends of our mooring plot the cut is 32 foot were we r moored it is mostly 40 foot due to errosion
  2. this is one of my points ours is a private end of field mooring established over 40 years , and even if i vacated my mooring tomorrow it isnt up to bw to let anyone have it and it never has been in fact the landowner if he wanted to could close all of this mooring space and then nobody could use it and bw would be left to re moor another ten boats trhanks very much carl
  3. carl could you please elaborate on your particular case as its great to hear of someone winning in court over bw , because no offence to any of the people who have answered, but im fed up of hearing about one case in 1992 and three blokes on the lancashire canal in 1996 lol surley there r more cases than this or i would say bw lacks confidence and is relying on the fear factor of two maybe three obscure cases cheers.
  4. hello mate im on the staffs and worcs wolverhampton
  5. another problem is that bw have not dregded the cut at ll by us and we have had to moake our mooring off the bank with scaffolding because the bank his not safe and theres load of silt. could i not say that the invoice they have given me is no good because they have not provived any services fit for the purpose ?
  6. ok many thanks o gpt a court summons in front of me ask in if i [ admit the unpaid mooring charges or contest them ??? cant really haggle at this stage can i ?
  7. if this mooring charge is not covered by legislation how can they take me to court thanks
  8. the landowner ignored them at first and gave me a yearly ticket saying paid $$$$ for private moorings. but now he writes paid $$$ for access across his land ( no mention about private moorings on ticket any more ) he has no agrrement with bw he gave my name and some patrol guy from bw took boat licence details then i got a bill for private mooring from bw i also had letters saying i may not be able to re-licesne my boat ( but it got renewed ok ) so have they any legislation to back up there charges or is something thay have decided to charge . has an actual act been passed
  9. any one see a man pulling his boat 74 miles from chester to wolverhampton last week. wpulling his boat till 2 am in the morning
  10. if i take my boat from that mooring british waterways have no right to put anyone else there so how can they enforse a chargecustodians of the water ways ????? they have not asked for any fees for the past 40 years . so why bother asking and charging nowthe canals are for leisure now not highways any longer
  11. paying to be on the water already though ?
  12. i want to know if i have to pay british waterways to moor my boat . i have a bw licence and pay a private landowner to moor off his land on bw canal. they are taking me to court for unpaid charges . but i dont think there is any legisslation to really enforce it any thoughts. thanks
