  3. The length of wall in Holme lock Cut which C&RT have confirmed in writing as the VM's displays no signs of any kind, and in fact, I've never once tied up to it since I've owned this boat. I always used other parts of the Lock Cut, including a piled wall on the opposite(North)side owned by the EA, but even there I never stayed longer than 14 days consecutively. Parry is either knowingly lying, or he is just regurgitating lies told to him by the Enforcement Orifice.

If it does go to a hearing on 24 November I think we'll get a decision on the day, but I really don't think even C&RT will want to push it that far. >>This man has acted unreasonably by not breaking the Law and renewing his boat Licence when it was due, and in doing so has wrecked our case against him<< . . . would you want to stand in front of a Judge and say that, or words to that effect?

To be strictly correct, the Civil Procedure Rules[Part 38(6)] as applicable here, make a Claimant who files and serves Notice of Discontinuance liable for all the Defendants costs up until the time of service, unless the Court orders otherwise. So C&RT are, in effect, now asking the Court to let them off something they've already agreed to, in writing, on 27 August 2014.
  6. To be quite honest I really don't know. In fact, selecting me was one of his very much less despicable episodes, his more usually preferred targets for perfecting his bullying and intimidation skills have included a man in his seventies living alone on his boat and incapacitated whilst recovering after an operation, and a woman alone on a boat while her terminally ill husband was undergoing hospital treatment. What I find most disturbing about this particular Enforcement Orifice( Stuart Garner) is that his immediate superiors, as well as Parry himself, think that he's beyond reproach.

In fact, it was, because C&RT revoked my boat Licence on 3 January 2014 after some weeks of provable compliance with the (unlawful) requirements laid out in their last 'do as we say or else' letter in early December 2013. Such was their New Year enthusiasm for revoking my Licence, they did it without even bothering to check for, obtain, or falsify any proof of non-compliant lack of boat movements for the preceeding weeks. Incidentally, none of this has in the least way prevented me from getting on with my life, quite the contrary, in fact, I've thoroughly enjoyed it, knowing that C&RT hadn't got a hope, but that it may be possible, thanks in no small part to the help and advice I've received, to show others who may find themselves in a similar situation, that C&RT don't have to be allowed to get away with their attempts to intimidate, bully and rob anyone who takes their fancy.
  9. What, in fact, I did was, as I do every year, apply to renew my Licence from it's normal annual renewal date ( 1 July). In consequence, C&RT are now saying that my unreasonable conduct in complying with the Law by renewing my Licence from the due date has wrecked their Court case against me, and for that reason they are now asking the Court not to award my Costs against them. They applied, giving that reason, to the Court for a ruling on Costs to made without a hearing, but did not succeed in that and a hearing to rule on their Application has been fixed for 24 November 2014 by the Judge. I hope he realises as a result of that he may incur the disapproval of some Members of this Forum.

I'm assuming that 'do' is a typo, nonetheless thanks for posting that, it's nice to know that there are those following this who can identify and address the real issues in respect of others who may in the future find themselves threatened by C&RT for merely doing what they've paid a licence fee for the right to do. PS. I am just a bit curious as to why you think those on this Forum who say I'm 'obnoxious' are 'probably right', given that none of them either know or have even met me.
  11. As long as you continue being prepared to submit to C&RT's every whim, legal or otherwise, all your boats may be quite safe, after all, where in history are there any recorded instances of dictatorial regimes abusing those within their influence?
  12. You've got one thing partly right in that. There certainly have been plenty of unsubstantiated accusations, but they've all originated from C&RT. Do you think that may have something to do with why they are now so anxious to stop the proceedings?

  14. Yes I did, and I'm very pleased with them. If certain people on this Forum ever start approving of anything I say or do, then I will begin to think that I'm getting things wrong. You can take the hard hat off, that's a good summary of what's happened, except that I was accused of not 'bona fide' cruising, rather than mooring. As to the cost of all this, you can ask C&RT. A Freedom of Information Request should produce an answer, or you could ask Parry himself, not an unreasonable thing to do, considering that he's been responsible for driving the whole thing on.

  17. The tripe you have put in that paragraph makes it very clear that, contrasting with those who's opinions are of some importance, you don't really understand the situation or what C&RT's solicitors have done.
  18. Yes it would be interesting . . . so how about it, all you C&RT backers and apologists, why don't you you get up off your knees, stop all the forelock tugging and tell us why?
  19. Is that the best you can manage? I bet you put about the same amount of thought and effort into tying up your boat don't you.
  20. It's not really going to be lonely is it? Surely not, with all those people whose boats I've bust loose complaining to me about it, and all the visits from the C&RT Enforcement Orifices . . . no, I don't think there's anything to worry about there.
  21. I'm sure you will . . . according to Parry and some of the other goons at C&RT I'm always tied up just below Nottingham anyway . . , why don't you give them a call and see if they can tell you just where to find me.
  22. I'm never anything but happy when boating. I've always enjoyed looking behind me and seeing boats with broken bits of rope hanging from each end and drifting all over the cut after I've gone past.

That's one of the daftest and most illogical remarks I've ever seen, considering that they were 'prosecuting' me as you call it for not moving around enough . . . it's hardly compatible with passing moored boats too fast is it. Anyway thanks for the kind thoughts, hope to see you tied up somewhere one day . . . I bet you're one of those who drape a couple of bits of rope from each end of your boat and then grumble at anyone that goes past.
