  8. Nibble, there is no definition of 'place'or 'bona fide navigation' in BW 1995. If I had a precedent where a judge relied on the CC guidance, I'd not risk ignoring it. Now I know that the CC guidance is unlikely to be considered definitive by a lower-level court, I will obey the law and treat the CC guidance with the contempt it deserves and take my chances in court. There's always Windermere if we lose.

  10. It's an impossibly difficult board search, but some have claimed exactly that. Now that we know, we will not be moving further than the next stretch of moorings unless we want to. I'm happy that we can satisfy a court that we comply with BW 1995.
  11. Where do you get that from Phyllis? I think I've explained why lines won't and can't always be tight. If they're loose, we move a lot. This is not a problem until a series of unnecessarily large bow waves go past. It's never one boat that sets us adrift, it's a succession of them, which happens remarkably often given that all boaters should have absorbed the handbook by the time they get on the tiller.
  12. If the lines are loose on the Ozford an over-enthusiastuc duck shifts the boat. And the constant back and forth movement can pull huge chunks of bank out. We don't care about being thrown around, we care about being set adrift three times before breakfast (we do get up late, tbf). If the pins don't pull out the bank gives way, We could plonk ourselves on those nice visitor moorings instead. Too many selfish boaters might force us to be less considerate ourselves next time we hit the Oxford. "I'm not slowing down for every moored boat!" … "Well, screw you too, we'll find ourselves a visitor spot. Hope you don't find them all full of CCers when you come back." Liveaboads on the Oxford sometimes thank us for slowing down. Half the fisherman we've passed do too. Very sad indictment of boaters in general. There seem to be an awful lot who are selfish, ignorant or both. Not good for the rest of us. At least we have no fear of maggots getting chucked at us, now we know why it happens.
  13. Where did I say it threw the guidance out? It just removes the ambiguity over whether satisfying the board is part of the law. The answer is no. You may be able to satisfy the law without satisfying the board. Both 14 day rules are now effectively the same, with the exception that those with home moorings can still ignore them with impunity whilst CCers who choose to obey the law but not the guidance may have to justify themselves in court.
  14. We have always used springs because that is what we were taught the very first time we went out on a boat. I'm clearly too stupid to know how they help when the level changes a lot, sometimes too rapidly for tight lines to be safe. Please do explain.
  15. You could also identify helpful types in each area. We picked up our first. boat from an area with no phone reception and stayed there a couple of days whilst we moved on board. The moment we got into reception his phone went nuts. My mother-in-law had had a stroke and wasn't expected to survive the weekend and he had to get there fast. We checked the maps for the closest station, bumped into Dusty who advised us where to head and phoned someone to ask them to help us out if they saw us. We left the boat on a lock-landing with apology notes in the canalside windows (not wanting to advertise our absence on the towpath side).. The yard sent someone to move it through the lock whilst I was still in London. I was on my own for the first few weeks CCing because he had to be in London, but lovely people helped me move. It helped that we were hiring out of season so the yard were there for us (David Dare and all at Heyford, you're diamonds, all of you). Full recovery, btw. She's started going out on her own most nights cos hubby slows her down. Nibble, you obviously prefer your expensive mooring to all your alternatives. That is all. Why are you going around in circles agreeing with me whilst pretending you don't? 'Market forces are for life, not just when it's convenient for you. Suck it up or oppose 'free' market capitalism like you so obviously should, given the views you express here.
  16. We often invite family and friends to crew when we want to bounce cars for a long cruise with no handy stations. We also offer free holidays when the boy wants a bath and unmetered internet for downloading. You might be able to do something similar for awkward fortnights? Travel time and costs as a CCer are massive, even if you live aboard. But lots of canals follow railway lines for considerable distances and we often hop berween stations for convenience (the boy doesn't drive). BW ought to be sympathetic too, if you let them know the score. RNIB might be helpful. Towpaths are very popular with blind walkers. There's no good reason not to be accommodating as long as you do your best to stick to the rules.
  17. What is there to argue with? Some crass stereotyping and a cheap attempt to get a rise. Carry on telling us how there was never any point in changing the law on rape so that it didn't exclude spouses. Give us the history you're so confident you know. Otherwise, there's nothing to engage with. Can you offer evidence to justify your position or not?

  19. And machinery never needs to be moved by roads not suited to their use, right? Why do short moorings exist on such waterways if it is unreasonable to moor a speedier small boat on them? Do you even know anything about Juno's mooring? I know you are trying really hard here, but try harder, yeah?
  20. Thrupp is 5 miles north of Oxford, Nibble. In an area too expensive for us to want to live on land there. There are cheap moorings all over, and there's always the option of keeping the boat further away from home, if excessive charges become worse than the cist and inconvenience of travel. It comes down to your personal preferences, and what it is worth to you. If the limited resource you want control of is desired by lots of others and those others have a high disposable income, it will be expensive for you to get what you want. This is no reason to bitch about people who have made different, cheaper, choices in life. You can't always get what you want. Learn to live with it cos green-eyed monster is not an attractive look.
  21. Yes. The judge said he wasn't going to use the CC guidance because it was not an accurate reflection if the law. Therefore, I have a reasonable expectation that, should the board declare itself unsatisfied, we will nevertheless be able to satisfy a court, as long as we comply with the 1995 Act. I have no idea why you think you're saying any different. The key difference is that some used to claim that the requirement in the Act to satisfy the board entailed obeying the CC guidance. We now have a precedent that states this us not the case. The CC guidance just tells you what patterns are unlikely to be called into question, but don't cover all ways of complying with the law.
  22. Yes, precisely. The Davies judgement gives a precedent for ignoring the CC guidance. If you can't satisfy the Board you might nevertheless satisfy a judge, so the 1995 Act is all you need to worry about until and unless there is a new precedent set. The pattern you describe is quite lawful. There is also no lawful reason we cannot moor up on a different stretch of moorings in the same 'neighbourhood' after 14 days. That part of the 14 day rule is now, in effect, the same for everyone, whether they have a home mooring or not.
  23. Can't see how any of that contradicts what I saud about market forces, Nibble. The rest is a matter of opinion and I see no need to repeat myself. We were offered Gunpowder Wharf, near Thrupp, for £75/month. We're glad we didn't take it now, but we'd be saving £150/month on travel alone, and a lot of diesel if I could access office facilities easily. What you are prepared to pay for a mooring before you're better off weekending or not owning a boat depends on your circumstances and preferences. Nothing else.
  24. Well yes. I'm suggesting that those who complain about 'fake CCers' would be more credible and more effective if they also complained about bridge-hoppers and over-stayers with home moorings. The fact that one 14 day rule has been defined and re-defined several times whilst the other has never been defined at all suggests that only one part of the problem is getting any meaningful attention from the green-ink brigade. Forgive me for trying to help them focus their energies more effectively.
  25. I'm failing to see a contradiction. Someone asked if there were rules that could be enforced on their local rowers and the answer is none. Someone else asked about speeding GRPs and I commented on the reasons why large boats are asked to slowed down past moored boats. But you've already said you're trolling this thread, so I don't know why I'm dignifying this nonsense with a response.
