No - you miss my point -

People should have enough common sense to work out what might be dangerous or hazardous places to use the device.

Safety legislation can't cover every possible potentially dangerous situation in warnings. People have to use a bit of 'common'

 

Is this the £2 or £5 argument???

You are making an assumption they had it.

Insurance can cover stupidity, ( car insurance would not be possible without so doing) however it does not cover negligence.

So they might be insured, whilst a car with a bald tyre could not be insured.
