  1. And so to finish this saga. ive personally meet with CRT and the police and now have the full story Mr X. . . .rented the boat to my wife and I 18 months ago by selling me a 1/64 share. (my apologise Mtb i had not done my sums correctly (£20000 divide by 64 = £312.50)) 6 months later we move off the boat selling our 1/64 share to a new tenant. a Mr L.F.G as per the 63/64 share holders (Mr X.) instructions everyone was happy Mr L.F.G then registered the boat as his own claiming he was the 64/64 share holder with CRT unaware of Mr L.F.G's re-registering of the boat Mr X. sells the boat legally to Mr Z. He also legally informs Mr L.F.G that when his 6 month tenancy is up that he would have to move off the boat as its being sold Mr L.F.G claims that as 1/64 owner of the boat he DOES NOT have to move and that the boat cant be sold as he is a registered owner. HENCE THE CIVIL DISPUTE To conclude. . . . Mr L.F.G was evicted from the boat and paid back his 1/64 share (£312.50) and the new owner (Mr Z.) took possession of the boat Mr X. has now shown proof to CRT and the police. That the contract was only for 6 month and the percentage of ownership that Mr L.F.G had was only 1/64 Mr Z. has now full ownership of the boat and possession of it. unfortunately there's a lot of red tape to be sorted before he can do anything with it thou. THE END. . . . .
  2. okay guys im not interesting in arguing here. to answer all questions. 1) i rented 1% from owner at end of tenancy he purchased my 1% back by returning my deposit. (chazzy) example. . . . . . boat value is £20000 divide by 64 = £312.50 (dont ask me why its divide by 64. for some reason it just is) £312.50 was my 1% share so i paid a deposit of £312.50 (my 1%share) my monthly rent was £312.50 (THIS IS RENT ONLY. NOT PURCHASING MORE SHARES) joint ownership meant i needed to have my own insurance for contents only. everything else was covered by landlords/majority owners insurance BSS was checked and found to be okay with these arrangements. 2) i no where the boat is but cant tell you MtB because for all i no you might be the crook who nicked it (no offence). im sorry but its a need to no kinda thing. plus ive been asked by CRT and the police not to. as boaters and there community talk a lot and they didnt want to spook the criminal(s) 3) the boat has only and ever had 2 owners as per the contract the owner had drawn up (99% owner and 1% to the tennant) CRT no were the boat is and so do the police as ive given them photos and GPS coordinates CRT say its a civil dispute BUT also that the boat might have been fraudulently sold making it a criminal offence. it seems that the new tenant is trying to rip of the true owner by selling there 1% (£312.50) as if they owned 100% (£20000) my involvement in this debarkal of a story is. i went to go and view a boat only to find this very boat in question (ABACUS 72101) but re-painted and disfigured. 2 days later by chance searching google "springer 34ft" brought up "lady mucks" forum page Stolen Boat Taken From Kensal Green - Blue 34FT Springer with a picture of it too. taken i might add by what looks like the fraudulent party involved i posted on this forum because i rented the very boat in question 18 months ago without ANY problems and was trying to reach the landlord/owner to helpout as id seen the boat that previous weekend but he's changed his mobile number. thanks to some advice from some of the posts here ive made contact and things are being delt with As a boater on the cut and a descent human being i dont want to see a good man lose his £20000 boat for £312.50 hope this answers all questions
  3. amen to that. to finish up CRT are very interested in this and so are the police
  4. but the new 1% owner would have to of signed a new contract with 99% share holder and this has not happened as the original contract states different names the unknowing new 1% owner will be in trouble the tenant never re-registered the boat under any new name. it is still held by the 99% owner the contract is with the 99% owner the 1% owner sold the bit with out majority owners knowledge or permission
  5. but he didnt just sell his 1%. he sold his 1% and the other 99% he didnt own to a third party that by what CRT are telling me
  6. in the case of this boat i think the tennant sold the boat to a third party knowning that he only owned 1% of it. then further his life buy buying a legit boat
  7. this is the thing . a contract has to be clear about what you are paying your money for. ie. is it towards buying more shares or just rental payments
  8. dont get me wrong. i personally think there are way to many problems with this arrangement but it really comes down to how much you trust the majority share owner if such a problem was to arise. but on a side note. it is legal to do a rent to buy. from my experience everything worked out okay and i enjoyed my time on the cut. but by what this topic is really about the true owner of this boat was taken for a ride by the tenant after me and as i have such fond memory's of my wife and on on this boat. i wont to see justice done and the criminals caught.

  10. again this all comes under the fine print of the contract. the deal i had was any work to be done i paid for it then got a receipt which i forwarded onto the landlord/majority owner and he would minus this from my next rent payment
  11. im sorry i cant say where it is. but the police have informed me they have it under surveillance and CRT are putting me in touch with the real owner
  12. as long as the parties have a solicitor made legal contract that both/all parties agree to then theres no problem. at a later date its also a good way to buy a boat if the majority owner wishes. you can buy more shares till you have full ownership and again get a legally binding contract.
  13. the owner of the boat rented it to me by selling me 1% of the boat. that covers all the legal side of it. he had it all drawn up in a offical marine contract. "lady muck" ive PM'd my phone number to you can you forward it from there or if you want to discuss it further
