  6. By promoting the boat (brochures, websites, advertising it) they are telling the market that they are making it available to purchase (from them). The buyer pays the broker. The broker deducts their 6% (?) and pays the balance to the previous owner. The broker is the intermediary between the seller and the buyer - they are in the supply-chain. It would seem that the BMF have decided that their brokers are distributors and they are 'making the boat available on the market' so, have to comply with the RCD / RCR rules. My Son is working overseas and has a car sat in our yard just 'rusting away', we have cancelled the insurance, we have 'sorned' it and just occasionally start it up. After several years of not using it he asks me to 'stick it on ebay' and see what we can get for it. I write the advert and say it can be collected from my address & I list it. Am I selling the car ? Edit at 15:40 I should have said "am I making the the car available on the market?"

  9. There have been a number of threads over the last 3 or 4 years stating that the broker will not handle the sale without a valid RCD, or PCA. If I remember correctly @matty40s has some knowledge of the situation and has posted about it. A bit like climate change deniers - it doesn't exist until it affects them directly.

That all changed some years ago to be 'placed on the market'., that has subsequently been 'added to' ; While the “old” Directive considered the action of “placing on the market and/or putting into service”, the new Directive broadens the scope to the action of “making available”. A product is made available on the market when supplied for distribution, consumption or use on the Union market in the course of a commercial activity, whether in return for payment or free of charge. The concept of making available refers to each individual product and implies that all economic operators in the supply chain have traceability obligations and need to have an active role in ensuring that only compliant products circulate on the Union market. A product is placed on the market when it is made available for the first time on the Union market. The operation is reserved either for a manufacturer or an importer as the manufacturer and the importer are the only economic operators who place products on the market

The responsible divison of the BMF that cover boat sales outlets and brokers is the BRMA (Boat Retailers and Brokers Association) whose code of practce for all member to adhere to includes the following section : 15. All Boat Retailer and Brokers shall have and/or will offer to clients:- a. Appropriate Professional indemnity insurance to cover errors and omissions occurring in the course of their broking activities b. Use their best endeavours to verify the complete history of ownership of Any 2 hand craft offered for sale c. Use their best endeavours to verify (if possible) the VAT status of 2 Hand Craft, advising prospective clients of any VAT liabilities that may exist in the absence of proof positive of VAT paid status. d. All craft offered for sale to conform with relevant legislation (RCD etc) e. For 2 Hand craft the ability to offer clients a choice of at least 3 suitably accredited surveyors from IIMS, RINA or YBDSA f. Staff training – minimum standards and staff development and on-going training So to answer your question all BMF / BRMA members have 'signed up to', and agreed that they will not sell a boat which does not comply with the RCD and has all those things in place that I listed a couple of days ago : Before making a product available on the market, the distributor must verify that: • The product bears the CE marking as required in Article 17 • It is accompanied by the following documents: Declaration of Conformity, Instructions and safety information, The owner’s manual in the appropriate language for the craft and the engines if installed • It meets the product identification and traceability requirements, the manufacturer’s identification or the importer’s identification if applicable

JCB have been trialling them on construction sites, but so far have found that they only get a very few hours use out of them digging foundations and it took a generator running almost all night to recharge them.   13. Running a diesel generator on a building site to recharge the electric diggers etc must use DERV.

  16. Do some checking into HVO production - it seems that the vast majority is coming from areas that have been deforested and local wildlife killed or moved on. Palm Oil has a very poor reputation amongst the 'save the planet brigade'.

It used to be about the dye and it was pretty easy to remove and so much so that much of the non-garage diesel sold in Ireland was 'washed rebated tax diesel' Red diesel now has a 'chemical marker' which cannot be removed it is bonded at a molecular level to the fuel molecules.   18. HMRC are happy (it was their suggestion) for a 60/40 declaration and they will not investigate a boater making that claim.

I'd imagine that it has very little by the fact that the manufacturers supply a vinyl coated version which gives up to 42 days weather resistance between laying the floor and finishing the roof, so, if it gets rained on during a house build it wont dissolve. Once completed the vinyl is peeled off and the final floor coverings can be put down.   20. As I understand it Red diesel for propulsion is taxed at 57.95ppl the same as DERV. Red diesel for non-propulsion (domestic) use is taxed at 11.14ppl I think you are maybe confusing the duty paid with with split declaration.

  22. White diesel (DERV) from garages will be cheaper than full duty paid Red diesel from a marina (its all about volumes) Red Agricultural diesel is charged at 5% duty and 5% VAT
  23. It doesn't look like a bunded bowser, it looks like a 'ground tank' simply ratchet strapped onto a trailer (is it road legal ?) What size is it ? Unless you have an ADR licence to tow a fuelbowser you'll need to ensure its under 1000 litres. having a 2000 litre tank with 1000 litres in it doesn't count !
  24. But did you look at the others linked ? £300 & £750 in the greater scheme of boating costs, that is 'just a few 100s' How much were you budgeting on for a tank ? Getting an 'approved' plastic tank (as used for central heating kerosene) will cost over £1000, and with delivery on top, then a few £100 more for a pump and dispensing hose and nozzle it's way more than a bowser.
